New Telecom Rules Likely to be Implemented from September 15: Here’s What Will Change

Starting September 15, millions of telecom users in India may experience significant changes as new regulations are set to be implemented. These rules, recommended by the Telecom Regulatory Authority of India (TRAI) to the Department of Telecommunications (DoT), are expected to be enacted shortly after the Lok Sabha elections. Part of the Telecom Act 2023, the new regulations aim to modernize the country’s telecom laws and enhance security and data privacy.

Background

The Indian Parliament passed the Telecommunications Bill, 2023, on December 20, 2023. This act is a comprehensive reform of India’s telecom laws, updating century-old regulations that include the Indian Telegraph Act of 1885, the Wireless Telegraphy Act of 1933, and the Telegraph Wires (Unlawful Possession) Act of 1950. The new legislation introduces 35 to 37 provisions to address the evolving technological landscape and aims to safeguard users’ interests in the digital age.

Key Changes Under the New Rules

  1. Mandatory Biometric Verification
    • One of the pivotal changes involves mandatory biometric verification for obtaining new SIM cards. This measure is designed to prevent the issuance of fake SIM cards and curb cyber fraud.
  2. Data Privacy and User Information
    • Clear guidelines will be established for telecom companies, internet service providers, and intermediary companies regarding the collection and handling of user data. These guidelines aim to prevent the misuse of personal data and enhance data privacy.
  3. Spectrum Allocation for Satellite Internet Services
    • The new rules also address the allocation of spectrum for satellite internet services. TRAI has recommended that spectrum be allocated to satellite companies for point-to-point connections, rather than direct retail services. This ensures that satellite companies do not gain an undue advantage while also maintaining a fair competition landscape for telecom companies.
    • Companies wishing to launch satellite internet services in India will need to purchase spectrum from the government, ensuring a regulated and controlled entry into the market.

Government Crackdown on Cybercrime

In a significant move to combat cybercrime, the government has instructed telecom companies to block around 1.8 million mobile numbers. This initiative follows an order by the DoT to disconnect over 28,000 mobile handsets used for cybercrime activities. This large-scale action is seen as one of the most substantial steps taken by the government to date to address cyber fraud and enhance online security.

The upcoming telecom regulations mark a critical step in reforming India’s telecom sector, addressing modern challenges, and enhancing security and data privacy for users. As these changes come into effect from September 15, telecom users can expect a more secure and regulated environment, aligning with global standards and technological advancements.
